Lawsuit Filed Against Family Dollar

Attorney James Sabatini on behalf of his client, a store manager at a Connecticut Family Dollar store, has filed a lawsuit against the company alleging pregnancy discrimination and unpaid overtime. While pregnant, the employer refused to allow our client to continue to work due to her pregnancy. As a long time assistant store manager and store manager, our client routinely worked more than 40 hours per week but was never paid overtime. Family Dollar misclassified her as an exempt employee.

In 2006, a judgment was entered against defendant's parent corporation, Family Dollar Stores, Inc., on behalf of approximately 1,200 store managers from around the country whose job description and duties were the same as the plaintiff. The case entitled, Morgan, et al. v. Family Dollar Stores, Inc. 2006 WL 1388201 (N.D. Ala. March 31, 2006), claimed that the store managers were misclassified as "executives" under the Fair Labor Standards Act, 29 U.S.C. Section 201, et seq., and claimed that they had thus been denied overtime wages.
